Terms of Use
Effective Date: July 29, 2026 · Last Updated: July 29, 2026
These Terms of Use ("Terms") govern your access to and use of ModernLifePlanning.com and any other online service that links to these Terms, collectively referred to as the "Site."
The Site is operated under the Modern Life Planning name ("Modern Life Planning," "we," "us," or "our").
Please read these Terms carefully. They contain important disclaimers, limitations of liability, and a binding individual-arbitration provision.
1. Acceptance of These Terms
By accessing or using the Site, you agree to these Terms and acknowledge our Privacy Policy.
If you do not agree, do not use the Site.
If you use the Site on behalf of a company, trust, partnership, or other organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site.
The Site is directed primarily to users located in the United States. We do not represent that the Site or any service discussed on it is appropriate, available, or legally permitted in every jurisdiction.
3. Educational and Informational Purpose
The Site provides general educational information concerning topics that may include:
- Life insurance and family protection;
- Retirement planning;
- Investments and wealth;
- Longevity and long-term planning;
- Business continuity and succession;
- Key person and buy-sell funding;
- Executive benefits;
- Financial decision-making;
- Related insurance and planning subjects.
Site content is general in nature. It is not individualized financial, investment, insurance, legal, accounting, medical, or tax advice.
You should not make or change an insurance, investment, retirement, business, estate, legal, or tax decision solely on the basis of Site content.
4. No Professional Relationship Created by Site Use
Visiting the Site, reading content, subscribing to a newsletter, submitting a contact form, scheduling an introductory conversation, or communicating through the Site does not by itself:
- Create an investment-advisory relationship;
- Create an insurance producer-client relationship;
- Create an attorney-client, accountant-client, or other professional relationship;
- Create a fiduciary relationship;
- Require us or another professional to monitor your financial circumstances;
- Require us to provide ongoing advice or update previous information;
- Guarantee that we will accept or pursue your request;
- Constitute an insurance application or investment-account application;
- Bind an insurance carrier, investment adviser, custodian, broker-dealer, or other institution.
A regulated or professional relationship begins only when the required licensed or registered professional accepts the engagement and all required agreements, disclosures, authorizations, and applications have been completed.
Any duties associated with such a relationship arise from applicable law and the separate written agreement—not merely from your use of the Site.
5. Licensing and Availability of Services
Insurance and investment services are regulated and may be offered only through appropriately licensed, appointed, or registered persons and firms.
Nothing on the Site represents that Modern Life Planning, its founder, or any affiliated or referred professional is licensed, registered, appointed, or authorized to provide every service in every state.
Services are available only:
- Where legally permitted;
- Through an appropriately licensed or registered professional;
- Subject to applicable eligibility, suitability, underwriting, carrier, custodian, and regulatory requirements;
- After all required disclosures and agreements are completed.
A professional's background and registration should be verified through the appropriate state insurance department, the Securities and Exchange Commission's Investment Adviser Public Disclosure database, or the Financial Industry Regulatory Authority's BrokerCheck system, as applicable.
6. Insurance Information and Products
Insurance content on the Site is general educational information. Product availability, features, premiums, costs, riders, exclusions, underwriting standards, cash values, guarantees, tax treatment, and benefits vary by carrier, product, jurisdiction, and individual circumstances.
No Site content is an insurance contract, binder, illustration, quote, application, or guarantee of coverage.
Insurance coverage is effective only after:
- An application is completed;
- Required disclosures and authorizations are provided;
- Underwriting is completed where applicable;
- The insurance carrier approves and issues the policy;
- Required premiums are paid;
- All policy conditions are satisfied.
Policy guarantees are based on the claims-paying ability of the issuing insurer and are subject to the terms, exclusions, limitations, and conditions of the policy.
Statements about tax treatment are general. Life-insurance proceeds, cash-value access, withdrawals, loans, transfers, and business uses may have tax consequences depending on the policy and circumstances. Consult qualified tax and legal professionals.
Do not cancel, replace, surrender, borrow against, or materially change an existing insurance policy until you understand the costs, risks, surrender charges, replacement rules, contestability periods, and potential loss of benefits.
Insurance professionals may receive commissions or other compensation from insurers. Required compensation and conflict disclosures will be provided as applicable.
7. Investment and Retirement Information
Investing involves risk, including possible loss of principal. No investment strategy, asset allocation, security, product, projection, or planning method can guarantee a profit, prevent loss, or ensure a particular retirement outcome.
Past performance does not guarantee or reliably predict future results.
Examples, projections, assumptions, calculators, and illustrations are hypothetical unless expressly identified otherwise. Actual results may differ because of market conditions, fees, taxes, inflation, withdrawals, timing, personal circumstances, and other factors.
The Site does not constitute an offer to sell securities or a solicitation to buy securities. Investment-advisory services, if offered, will be provided only through an appropriately registered investment adviser and under a separate written agreement.
8. Legal, Tax, Accounting, and Estate Matters
Modern Life Planning is not a law firm, accounting firm, or tax-preparation service unless expressly stated in a separate written engagement.
Discussion of trusts, estates, business succession, buy-sell agreements, executive benefits, taxation, or business structures is educational and does not replace advice from a qualified attorney, Certified Public Accountant, tax professional, benefits professional, or other appropriate specialist.
Any legal agreement—including a trust, will, buy-sell agreement, employment agreement, succession document, or deferred-compensation arrangement—must be prepared or reviewed by qualified legal counsel.
9. No Guarantee of Outcomes
Modern Life Planning does not guarantee:
- Approval or issuance of insurance coverage;
- A particular insurance premium, rate, benefit, or underwriting classification;
- Availability of a particular carrier or product;
- Investment performance;
- Tax treatment;
- Retirement readiness;
- Business continuity;
- Estate-planning outcomes;
- Acceptance by a registered investment adviser or other professional;
- Any specific financial or commercial result.
Planning recommendations depend on the completeness and accuracy of the information provided. Results may change as laws, markets, products, rates, health, finances, family circumstances, and business conditions change.
10. Accuracy and Timeliness of Site Content
We seek to provide credible and useful information, but financial, insurance, tax, legal, regulatory, and market information can change.
We do not warrant that Site content is complete, current, error-free, or suitable for a particular person or purpose. Content may include inadvertent technical, typographical, or factual errors.
We may update, correct, remove, or discontinue content without notice. We do not undertake a duty to update previously published content.
You are responsible for independently verifying material information before acting on it.
11. Information You Provide
You agree that information you submit will be accurate and that you will not impersonate another person or submit information without authorization.
Do not submit through general Site forms or ordinary email:
- Social Security numbers;
- Financial-account passwords;
- Full bank, brokerage, or payment-card numbers;
- Full insurance-policy numbers;
- Government identification documents;
- Medical records;
- Confidential information belonging to another person or business;
- Information you do not have authority to disclose.
Submitting information does not require Modern Life Planning or any third party to act on it.
12. Communications
If you submit an inquiry or schedule a conversation, you authorize Modern Life Planning and the professional handling your request to contact you at the email address or telephone number you provided regarding that request, subject to applicable law.
Providing a telephone number through a general contact form does not constitute consent to receive automated marketing calls, prerecorded marketing calls, or marketing text messages.
Any legally required consent for automated or prerecorded marketing communications will be requested separately. Consent to marketing communications is not a condition of purchasing a product or receiving a service.
Email and ordinary text messaging may not be secure. Do not use them to transmit sensitive financial, insurance, health, or identification information.
13. Privacy
Our collection and handling of personal information through the Site are described in our Privacy Policy.
Separate privacy notices may apply when you engage an insurance carrier, registered investment adviser, custodian, broker-dealer, or other regulated professional.
14. Permitted Use
You may use the Site only for lawful, personal, and informational purposes.
You may not:
- Violate any applicable law or regulation;
- Use the Site for fraud, impersonation, harassment, or unlawful solicitation;
- Attempt to gain unauthorized access to the Site or related systems;
- Introduce malware, malicious code, automated attacks, or harmful material;
- Interfere with Site security, operation, or availability;
- Scrape, crawl, harvest, or extract Site content or personal information through automated means without written permission;
- Circumvent access restrictions or security controls;
- Copy, reproduce, republish, sell, license, or commercially exploit Site content without written permission;
- Remove copyright, trademark, attribution, or proprietary notices;
- Use Modern Life Planning's name, content, or branding in a misleading manner;
- Suggest an endorsement, affiliation, license, or partnership that does not exist;
- Use Site content to train, develop, or improve an artificial-intelligence model without written authorization;
- Submit false, misleading, infringing, defamatory, or unlawful material.
We may restrict or terminate access when we reasonably believe these Terms have been violated.
15. Intellectual Property
The Site and its original content, design, graphics, branding, logos, text, organization, and other materials are owned by or licensed to Modern Life Planning and are protected by intellectual-property laws.
Modern Life Planning grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for lawful personal and informational purposes.
No ownership rights are transferred to you.
You may share links to publicly available Site pages, provided that you do not misrepresent the content, remove attribution, frame the Site in a misleading manner, or imply an unauthorized endorsement.
16. Feedback and Submissions
If you submit feedback, suggestions, or general ideas about the Site, you grant Modern Life Planning a nonexclusive, worldwide, royalty-free right to use that feedback to improve the Site and its services without payment or attribution.
This section does not give us ownership of your personal financial information, insurance information, confidential documents, or other information protected under our Privacy Policy or applicable law.
Do not submit unsolicited confidential business ideas, trade secrets, or proprietary proposals through the Site.
17. Third-Party Websites and Professionals
The Site may link to or reference third-party websites, insurance carriers, registered investment advisers, custodians, broker-dealers, attorneys, accountants, scheduling platforms, social media services, or other providers.
Third parties are responsible for their own products, services, content, security, privacy practices, representations, fees, advice, and conduct.
A link, reference, referral, or introduction does not necessarily constitute an endorsement or guarantee.
Any engagement with a third party is governed by the agreements and disclosures between you and that third party.
18. Site Availability
We may modify, suspend, restrict, or discontinue any part of the Site at any time.
We do not guarantee uninterrupted, secure, or error-free access. The Site may be affected by maintenance, technical failures, cybersecurity events, service-provider disruptions, or circumstances beyond our control.
We are not responsible for losses caused solely by an inability to access the Site.
19. Disclaimer of Warranties
To the maximum extent permitted by law, the Site and all content are provided "as is" and "as available."
Modern Life Planning disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and results.
We do not warrant that the Site will be uninterrupted, error-free, free from harmful components, or suitable for your particular circumstances.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent legally permitted.
20. Limitation of Liability
To the maximum extent permitted by law, Modern Life Planning and its owners, officers, employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for lost profits, lost opportunities, loss of data, loss of goodwill, or business interruption arising from or related to the Site.
To the maximum extent permitted by law, the total liability arising from or relating to the Site will not exceed the greater of:
- The amount you paid Modern Life Planning specifically for access to the Site during the 12 months before the event giving rise to the claim; or
- One hundred U.S. dollars.
These limitations do not exclude liability that cannot legally be excluded, including liability for fraud, willful misconduct, or other liability that applicable law prohibits limiting.
A separate professional agreement may contain different liability provisions for regulated or paid services. That agreement will control the services governed by it.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Modern Life Planning and its owners, officers, employees, contractors, and representatives from third-party claims, losses, liabilities, damages, and reasonable expenses arising from:
- Your unlawful or unauthorized use of the Site;
- Your material violation of these Terms;
- Information or material you submit without the right or authority to do so;
- Your infringement of another party's intellectual-property, privacy, or other legal rights.
This section does not require you to indemnify a party for that party's own fraud, willful misconduct, or other conduct for which indemnification cannot lawfully be required.
22. Informal Dispute Resolution
Before beginning arbitration or litigation concerning these Terms or the Site, the party asserting the dispute must send a written notice describing:
- The party's name and contact information;
- The facts underlying the dispute;
- The legal basis for the claim;
- The relief requested.
Notices to Modern Life Planning must be emailed to [email protected] with the subject line "Legal Dispute Notice."
The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of the notice.
This requirement does not prevent either party from seeking urgent temporary relief needed to prevent immediate harm, preserve legal rights, or protect intellectual property.
23. Binding Individual Arbitration and Class-Action Waiver
Except for matters eligible for small-claims court or requests for temporary injunctive relief, a dispute arising from these Terms or use of the Site will be resolved through binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules.
The arbitration will be conducted by one neutral arbitrator. It may be conducted remotely, by written submissions, or in Orange County, California, as permitted by the applicable rules and law.
The arbitrator may award any individual remedy available in court but may not consolidate claims or preside over a representative or class proceeding unless both parties agree.
You and Modern Life Planning agree to bring claims only in an individual capacity. To the maximum extent permitted by law, neither party may participate as a plaintiff or class member in a class, collective, consolidated, private-attorney-general, or representative proceeding.
You and Modern Life Planning waive the right to have a dispute covered by this section decided by a judge or jury.
Arbitration opt-out
You may opt out of this arbitration provision by emailing [email protected] within 30 days after first accepting these Terms.
The email must:
- Use the subject line "Arbitration Opt-Out";
- Include your full name;
- Identify the email address used in your Site interaction;
- Clearly state that you are opting out of the arbitration provision in the Modern Life Planning Terms of Use.
Opting out of arbitration will not affect the remaining Terms.
If a court determines that a particular claim or remedy cannot lawfully be arbitrated, that claim or remedy will be decided by a court after all arbitrable matters have been resolved, unless applicable law requires otherwise.
This arbitration provision applies only to disputes concerning the Site and these Terms. A separate insurance, investment-advisory, or professional agreement may contain different dispute-resolution provisions that control that relationship.
24. Governing Law and Court Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law controls.
For a dispute not subject to arbitration, the parties consent to the exclusive jurisdiction of the state courts located in Orange County, California, and the United States District Court for the Central District of California.
Nothing in these Terms prevents a consumer from exercising a non-waivable right under applicable law.
25. Time Limit for Claims
To the extent permitted by law, a claim relating to the Site or these Terms must be filed within one year after the claimant knew or reasonably should have known of the facts giving rise to the claim.
This section does not shorten a limitations period that applicable law prohibits the parties from shortening.
26. Changes to These Terms
We may revise these Terms prospectively to reflect changes in the Site, business practices, or law.
Updated Terms will be posted with a revised "Last Updated" date. Material changes will receive additional notice where required.
Changes will not retroactively alter the resolution of a dispute that arose before the revised Terms became effective unless the parties agree or applicable law permits.
Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms.
27. Termination
We may suspend or terminate your access to the Site if you violate these Terms, create a security risk, engage in unlawful conduct, or misuse the Site.
Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law—will survive.
28. General Provisions
If a provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum lawful extent, and the remaining provisions will remain effective.
Our failure to enforce a provision is not a waiver.
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the Site or business.
These Terms and the Privacy Policy constitute the entire agreement governing general use of the Site. They do not replace a separate written agreement governing insurance, investment-advisory, or other professional services.
Section headings are provided for convenience and do not limit the meaning of a provision.
